Digital assets can create difficult questions about ownership, custody, evidence, access, valuation, and transfer. The legal strategy must account for both the governing law and the technical reality.

Direct answer

What makes a digital-asset legal plan workable?

A workable plan coordinates legal ownership, fiduciary authority, custody, evidence, tax records, and secure recovery. Florida Chapter 740 can govern a fiduciary’s access to digital assets held by a custodian, but it cannot recreate a lost self-custody key.[Florida Statutes Chapter 740]

Protect evidence and access before sharing details

Digital-asset matters often turn on the difference between ownership, account access, custody, transaction authority, and evidence. A safe non-confidential starting summary can identify the asset type, the platform or custody model, the general transaction date, the dispute category, and any approaching litigation, estate, or response deadline. Never send seed phrases, private keys, passwords, authentication codes, or unrestricted wallet access through the website or ordinary email.

After conflicts are cleared and a written scope is established, relevant material may include account agreements, transaction identifiers, wallet addresses that are appropriate to disclose, exchange records, device or custody information, communications, and existing court or estate documents. Preserving original records and a reliable chronology can reduce avoidable evidentiary gaps. The firm does not provide investment advice, custody services, or guarantees concerning tracing, access, valuation, or recovery.
